It is previously specified that the present conditions govern exclusively the sales, by the association [noiseaddict] - Nostromo (Headquarters: Ch. De la Grande-Pièce 1 - 1227 CAROUGE - Switzerland) of editorial products (books, records, videos, DVDs, CD-ROMs, posters, etc.), of textile products (clothing, accessories, etc.).

Article 1 - Price

1.1 - The prices of our products are indicated in euros all taxes included (VAT + other taxes and in particular tax on the videograms, ...) except participation in the expenses of treatment and of forwarding (Modes of delivery).

1.2 - In case of order to a country other than metropolitan France you are the importer of the product concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not within the purview of the association [noiseaddict] - Nostromo. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies of your country. We advise you to inquire about these aspects with your local authorities.

1.3 - The association [noiseaddict] - Nostromo reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of your validation of order.

1.4 - The products remain the property of the association [noiseaddict] - Nostromo until full payment of the price. We remind you that when you take physical possession of the products ordered, the risk of loss or damage to products will be transferred.

1.5 - The association [noiseaddict] - Nostromo is not intended to sell to professionals, the products and services sold are reserved for individuals.

Article 2 - Order

You can place an order on the e-shop: www.nostromo-shop.com.

The contractual information is presented in French and will be the subject of a confirmation containing this contractual information at the latest at the time of your order validation. An English language version is available.

Article 3 – Validation of your order

You declare to have read and accepted these Terms of Sale before placing your order. The validation of your order is worth acceptance of these Terms and conditions.

A summary of the information of your order and the General Conditions of Sale, will be communicated to you in PDF format via the e-mail of confirmation of your order.

Article 4 - Availability

The association [noiseaddict] - Nostromo is a retailer and is not intended to sell in large quantities the products offered. As a result, the association [noiseaddict] - Nostromo reserves the right to refuse orders for the same product in large quantities and from 3 identical items. Our product offers are valid as long as they are visible on the site, within the limits of available stocks excluding promotional operations mentioned as such on the sites. In the event of unavailability of product after placing your order, we will notify you by email. Your order will be automatically canceled and no bank debit will be made. For information flow only occurs at the time of shipment of the package.

Article 5 - Delivery

5.1 - Overview

The products are delivered to the delivery address you indicated during the ordering process, except for delivery restrictions indicated in the section. « Modes of delivery », within the time indicated on the order validation page by the customer.

The delivery time corresponds :

  • the shipping time indicated on the form
  • processing time and routing.

In case of delivery by a carrier requiring an appointment with the customer, the latter will contact you as soon as possible to agree with you a delivery appointment, 30 days at the latest from the date of your order confirmation. The association [noiseaddict] - Nostromo can not be responsible for late delivery due exclusively to the unavailability of the customer after several proposals for appointments by the carrier.

When you order several products at the same time and they have different delivery times, the delivery time of the order is based on the furthest delay. The association [noiseaddict] - Nostromo however reserves the possibility of splitting shipments. Participation in processing and shipping costs will only be charged for one shipment. In case of delay of shipment, an email will be sent to inform you of a possible consequence on the delivery time which has been indicated to you. In case of late delivery, we will offer you by mail a new delivery time. In any case, in accordance with the legal provisions, in case of late delivery, you have the possibility to resolve the contract under the terms and conditions defined in Article L 216-2 of the Consumer Code. In this case, if you received the product, after your cancellation, we will refund the product and the costs "go" under the conditions of Article L 216-3 of the Consumer Code. We also invite you to regularly check your order tracking and to contact us for any questions or problems. In case of payment by credit card or private and split deliveries, only the products shipped are debited. We remind you that when you (or a third party designated by you) physically take possession of the products ordered, the risk of loss or damage to the products will be transferred. We remind you that if the delivery address is wrong when you inform at the time of the order, if the parcel returns to the recipient as being "Incorrect address", "Incomplete address", "NPAI", "Unclaimed" by the La Poste service or other carrier, your order is kept and you will be informed of its delivery status. In these cases, the return shipping costs will be requested at the rate of the initial shipment.

5.2 - Reserves

You must notify the carrier and the association [noiseaddict] - Nostromo all reservations about the delivered product (for example: damaged package, already open ...). If you do not do it, and the product does not come back to us, the refund can not be made under any circumstances. In the case of a limited series product, the exchange is not possible.

Article 6 - Payment

We remind you that the fact of validating your order implies the obligation to your charge to pay the indicated price. The payment of your purchases can be made according to the means of payment accepted by the association [noiseaddict] - Nostromo indicated in the heading "Means of payment". The debit card is only made when the order is shipped. The payment of your order is done in one time cash. No financing solution is put in place on the official shop of the association [noiseaddict] - Nostromo.

Article 7 - Securing

Our site is the subject of a security system. We have adopted the SSL encryption method, but we have also strengthened all the scrambling and encryption processes to protect all the sensitive data related to the means of payment as efficiently as possible. Transactions are also secured by 3D-Secure identification (cardholder authentication).

Article 8 - Right to retract

8.1 – Legal deadline for the right of withdrawal

8.2 - Contractual withdrawal period

Then you have another period of 14 days from the communication of your withdrawal decision to return the product or products concerned. In the case of an order containing several products, placed on www.nostromo-shop.com, the 14 days deadline to communicate your withdrawal decision runs from the receipt of the last product. The procedures for exercising your right of withdrawal are specified in 8.3.

8.3 Conditions of exercise of the right of withdrawal

8.4 - Products excluded from the right of withdrawal

In accordance with the regulations in force, the right of withdrawal can not be exercised for audio or video recordings unsealed by the customer, products manufactured according to customer specifications or personalized and goods not sealed by the customer and can not be returned for reasons of hygiene or the protection of the health, and the products in limited version.

8.6 - Refund

In case of exercise of the right of retraction, the association [noiseaddict] - Nostromo will refund the sums paid (including delivery costs) at the latest within 14 days from the date on which the association [ noiseaddict] - Nostromo is informed of your decision to withdraw and you will be refunded by bank transfer (send us by e-mail your RIB). This refund date may be deferred until the product is recovered or until you have provided proof of shipment of the product, whichever is the earlier. The association [noiseaddict] - Nostromo is not required to reimburse the additional costs if you have expressly chosen a more expensive method of delivery than the standard delivery method offered on www.nostromo-shop.com No sending in cash on delivery will be accepted for any reason. 

Article 9 - Guarantees

9.1 - Product conformity

In accordance with the provisions of the legal guarantees of conformity and latent defects (referred to in the box below and whose texts are specified in Appendix 1 of these conditions), we refund or we exchange the products apparently defective or not corresponding at your command. If you request a refund, please contact us at the accessible number indicated in the order confirmation email and available on your "My Account" page; to do this you just have to login using your e-mail address and your password. The products must be returned to us in the state in which you received them with all the elements (accessories, ...) in a packaging allowing a transport in good conditions. The shipping costs will be refunded based on the price charged and the return costs will not be refunded.

It is recalled that within the framework of the legal guarantee of conformity, the consumer :has a period of two years from delivery of the goods to act vis-à-vis its seller;    

can choose between the repair or the replacement of the good, subject to the conditions of cost envisaged by the article L. 217-9 of the code of consumption;    

is exempted from furnishing proof of the lack of conformity of the property during the six months following the delivery of the property. This period is extended to 24 months from March 18, 2016, except for second-hand goods.

The legal guarantee of conformity applies regardless of the commercial guarantee that may possibly cover your property. It is recalled that the consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between the resolution of the sale or a reduction the selling price in accordance with Article 1644 of the Civil Code. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 8.

9.2 Commercial guarantees :

Article 11 - Intellectual property

11.1 - All texts, comments, works, illustrations works and images reproduced or represented on the website of the association [noiseaddict] - Nostromo is strictly reserved under copyright and intellectual property and for the world whole. As such and in accordance with the provisions of the Code of Intellectual Property, only the use for private use subject to different or even more restrictive provisions of the Code of Intellectual Property is permitted. Article 13 - Governing Law - Litigation - Claims Processing - Mediation

Applicable law : This contract is subject to French law. The language of this contract is French. In case of dispute the French courts will be competent.

Complaint handling: For any complaint you can contact the customer service at the coordinates mentioned in Article 10 of these conditions.

The association Noiseaddict - [noiseaddict] adheres to the Code of Ethics of the Fevad (Federation of e-commerce and distance selling).

Article 14 - Personal Data
